A Design refers to the features of shape, configuration. pattern, ornamentation or composition of lines or colours applied to any article, whether in two or three dimensional (or both) forms. In simple words Design Registration protects the unique design of the Outer Structure of a finished product

Design is not the same as trademark and does not include any artistic work. A design which has been registered by its proprietor gives him the legal right to use the design for anything at his desire and prohibits others from using a design similar to the registered design. The design procures a legal recognition only if it is newly created, does not contain any obscene images and it should conform to the public morality. Design Registration helps in promoting the good will of the products in the International market, and helps in differentiating between the similar products produced under different brand names.

Design that cannot be registered

A design which is not new or original or if it has been disclosed to the public prior to the registration of the design, or if it is of such nature that it cannot be distinguished from the design of any other product, service or entity and it ceases to be recognized if it contains any obscene images, then it cannot be registered.
